Self-Storage Legislation Progresses in Connecticut, South Carolina and Vermont

Update 6/6/22 – Vermont Gov. Phil Scott signed H 74 into law on Thursday, updating legislation that pertains to self-storage. The measure addresses procedures for sending lien-sale notices via email, placing value limits on tenant stored belongings, applying late fees, and advertising auctions in places other than the local newspaper. It also provides guidelines for the disposal of personal property and towing vehicles after delinquency reaches 51 days.

5/24/22 – Legislation on self-storage lien laws has recently progressed in Connecticut, South Carolina and Vermont. One bill has been signed into law, while the other two are awaiting governor signatures, according to the a May 23 newsletter distributed by the national Self Storage Association to its members.

In South Carolina, Senate Bill 1178 (SB 1178) was signed by Governor Henry McMaster on May 13. Effective immediately, it enables self-storage operators to conduct lien sales online. The bill was introduced in March and passed the senate on April 5.

In Connecticut, House Bill 5148 (HB 5148) passed the house and senate this month and is awaiting approval from Governor Ned Lamont. It would permit the towing of motor vehicles, trailers and other vessels that belong to self-storage tenants who fail to pay rent. It would also allow operators to advertise and hold lien sales online, plus it eliminates the return-receipt requirement. If signed into law, it’ll go into effect on July 1.

In Vermont, House Bill 74 (H 74) passed the house in January and the senate this month. It’ll now go to Governor Phil Scott for his signature. The bill addresses several lien laws in the state that relate to towing of vehicles that belong to delinquent customers, newspaper advertising for lien sales and online auctions. In addition, it eliminates the requirement to send lien notices by Certified Mail and contains statutory protection for a contractual value limitation. If signed, it’ll go into effect on July 1.
