Pennsylvania Updates Self-Storage Lien-Law Legislation

Pennsylvania Gov. Tom Wolf signed House Bill 1103 (HB 1103) into law on Nov. 3, which will allow self-storage operators to advertise lien sales on online-auction websites in addition to a newspaper of general circulation. The measure also expressly authorizes the use of online auctions, gives the right to tow trailers after tenants are 60 days in default, and permits the administration of late fees. All changes go into effect on Jan. 3.

Though self-storage businesses must still advertise lien sales twice, they'll now have the opportunity to publicize auctions on “a publicly accessible internet website that regularly advertises or conducts online sales of personal property,” in addition to a notice in a local newspaper in general circulation.

The late-fee provision allows operators to impose late fees of $20 or 20% of monthly rent, whichever is greater, if tenants haven’t paid rent and other outstanding charges in full by the fifth day after their due date.

Introduced in April 2021, HB 1103 was unanimously passed in the senate on Oct. 26. It was supported by the national Self Storage Association and Pennsylvania Self Storage Association.
