Self-Storage Development and Zoning Activity: September 2022

Update 8/23/23 – Nearly a year after seeking a zoning change that would allow indoor vehicle storage for its project at 502 E. 4th St. in Ripon, California, Liberty Self Storage is set to pull permits and begin construction. Though the 170,300-square-foot development is in a heavy-industrial district, the company’s zoning request triggered a citywide review of indoor and outdoor vehicle-storage allowances across multiple districts. As a result, city staff recommended new lot-coverage limits.

The city council recently approved a new ordinance that applies to commercial storage developments in which more than three “recreation vehicles, boats and all-terrain vehicles” are stored on site. The measure stipulates that the “storage of recreational vehicles on site shall not exceed the maximum lot area building coverage percent for the district, regardless of whether the storage is indoor or outdoors. For outdoor storage, the building coverage percentage shall be calculated by the parking space size.”

The ordinance will go into effect 15 days after publication of the public notice.

7/25/23 – 2GR Equity and Connell Realty Services Inc. have completed construction of Cardinal Self Storage in Waxahachie, Texas. The three-story building at 181 Cardinal Road was designed by Merriman Anderson Architects and comprises 76,000 square feet in 570 units.

7/1/23 – Shredall EM Ltd., which submitted an application on behalf of Zenith Planning and Design, received its approval to convert a building in Hucknall, England, to self-storage. Community members had lobbied to turn the vacant property into a health center. In its decision, the council stated the proposal met the guidelines of the Ashfield Local Plan Review. Some conditions were imposed, including a limit on facility operating hours.

6/17/23 – InSite Property Group, which operates the SecureSpace Self Storage brand, is the developer seeking to convert the former Club Pure in Sayreville, New Jersey, to self-storage. The planning board is reviewing the site plan for the 100,500-square-foot project at 1970 Route 35. The existing building was once used to host private events. Based in Torrance, California, InSite has more than 50 locations either open or under development.

Liberty Self Storage is seeking a zoning change for its approved project in Ripon, California. The company submitted an application for a text amendment so it can add indoor vehicle storage in addition to traditional storage units. The planning staff determined vehicle storage would be allowed in the zoning district under certain parameters, including limiting lot coverage to 50%, planning director Ken Zuidervaart said during a May 15 meeting. The planning commission approved the amendment, which will now be passed to the Ripon City Council for review.

6/10/23DEStorage received preliminary site-plan approval from the Milton, Delaware, Planning and Zoning Commission for its proposed self-storage facility at Palmer Street Extended and Route 16. A meeting scheduled for May 18 was delayed to allow the developer to submit landscaping and lighting plans as well as revised building elevations. All four storage buildings will now be two stories, with two comprising 32,000 square feet each and the other two comprising 27,000 square feet each. A separate building will be constructed to house the management office. The site plan calls for stormwater-management ponds at the front and rear of the property. DEStorage will now seek approval from county and state agencies before returning for final city approval.

QOZ Self-Storage LLC opened phase one of the Allentown, Pennsylvania, Devon Self Storage location on 4th Street. The converted Kmart offers 57,287 rentable square feet, with an additional 34,500 square feet expected to be complete by April. The overall size of the facility, 91,787 rentable square feet in 769 units, is smaller than originally reported.

The site is one of 10 development projects planned by Self-Storage Qualified Opportunity Fund LLC, a joint venture between Devon and Inland Private Capital Corp., an Oak Brook, Illinois-based real estate investment manager. Inland’s self-storage portfolio comprises 173 properties across 29 states, many of which are managed by Devon.

11/3/22 – Officials in Lewiston, New York, blocked Vick Singh Ghotra’s proposed conversion of the Lewiston Event Center this week after determining self-storage isn’t a permitted use in the city’s business-one zoning district. With a 4-1 vote, the zoning board of appeals decided self-storage doesn’t align with municipal code Section 9, District Regulations, D.1.b.g., according to a source.

Before the vote, Ghotra’s attorney provided four paths to approve the project, but all were rejected. Corey A. Auerbach, a partner at Barclay Damon, said self-storage would fit under several uses in the code, including retail, personal-service establishment, or something similar. “It is not clear whether it is permitted or not permitted. And because zoning is in derogation of the common-law principles of private property, the courts of the state of New York—including the highest court, the court of appeals—routinely determined that that ambiguity must be resolved against the municipality who drafted the code, and in favor of the interpretation of the applicant,” Auerbach said.

Ghotra said he was told self-storage would be a permitted use. He presented copies of email correspondence he exchanged with city zoning officer Ken Candella to back up his claim.

Following the vote, the board invited Ghotra to pursue another use for the property that would fit within the code. Surprised by the board’s decision, Ghotra told the source he plans to discuss the project with his attorney to determine his next move.

10/27/22 – Developer Vick Singh Ghotra’s proposed conversion of the Lewiston Event Center in Lewiston, New York, has hit a road bump as officials try to determine whether self-storage is an accepted use in the zone. The uncertainty centers on the use of terms “primary vs. accessory” in the business-one zone, the definition of a warehouse, and city codes. Following an Oct. 11 discussion, the Historic Preservation Commission and planning board have tasked the building inspector and city attorney to interpret the village law and render a ruling. If found that storage isn’t an accepted use, Ghotra could seek a use variance from the zoning board of appeals. Both boards agreed to revisit the proposal once the zoning is determined.

10/24/22 – Janesville, Wisconsin, planners gave their unanimous recommendation to approve the rezoning and conditional-use permit needed by Midwest Indoor Storage. The company can now convert the former Crazy Joes furniture store on Milwaukee Street to self-storage and retail space. The plan also drew support from downtown business owners, including Todd Kimball, a self-storage operator who also owns commercial property along W. Milwaukee Street. The city council, which has final approval on the rezoning, is expected to vote on Nov. 17.

Built in the 1950s, the two-story, 43,000-square-foot brick building will undergo a significant exterior renovation to present three distinct storefronts. About 2,400 square feet will be reserved for retail.
