A man sharing a tenant’s unit to store items at Kangaroo Self Storage in Loveland, Colo., was arrested on Saturday after the facility manager found him slumped over the steering wheel of a car and later fighting with police. During the altercation, Joseph Abad of Fort Collins, Colo., allegedly slammed an officer’s finger in the car door and tried to disarm him. He faces two felony counts of assaulting a peace officer, felonies for attempting to disarm a peace officer and driving under the influence of alcohol, misdemeanor charges of obstructing a peace officer and resisting arrest, and a petty offense for trespassing, the source reported.

The manager called police around 10 a.m. on Dec. 16, believing Abad was passed out. Abad refused to leave the property upon request and wouldn’t identify himself to officer Burke Baldwin. Baldwin detected alcohol on Abad’s breath when he spoke to the suspect through an open window of the vehicle. Abad indicated he hadn’t had a drink in eight hours but didn’t say how much or what he had been consuming, according to an affidavit.

Once two additional officers arrived, Baldwin tried opening the car door, but Abad allegedly closed it on his finger. After the three officers opened the door, Abad stepped out of the vehicle and grabbed at Baldwin’s holster, trying to disarm him. Baldwin alerted the other officers and then punched Abad twice in the face, causing the suspect to let go of the gun, the affidavit said.

When the officers took Abad to the ground, he continued fighting and grabbing at their equipment. One officer attempted to apply a pain-compliance pressure point, which had no effect. Baldwin then used a vascular neck-restraint technique to get Abad to relax his hands and allow officers to use handcuffs.

The unidentified owner of the vehicle Abad was driving later arrived at the scene and told police he had permission to use her car and was storing items in the unit with her consent, according to the affidavit.

Investigators found a partially consumed bottle of Kentucky Bourbon whiskey in the vehicle. Abad had four DUI convictions between 1989 and 1999. The day he was arrested was his 54th birthday, the source reported.

Abad is being held at Larimer County Jail. A cash, property or surety bail bond was set at $5,000.
